BANKING
Prior to obtaining his juris doctorate in law, Mr. Phelan had a formidable career as a commercial and international bank loan officer, which provided him with extensive experience in installment, domestic, commercial and international loan lending, as well as knowledge of bank practices and procedures. While a banker, he was a member of the Florida Commercial Loan Bankers, Florida Installment Bankers and Florida International Bankers Association. As a lawyer, Mr. Phelan has acted as both general counsel and counsel for numerous Florida banks and is thoroughly familiar with the day to day operational aspects of banking. He has represented major federally charted banking institutions concerning litigation of all types as well as commercial and real estate lending and has also represented numerous financial institutions regarding money laundering/forfeiture issues. Mr. Phelan has also appeared as a guest lecturer at Florida International University on banking and consumer protection laws, and is the author of a paper on Bankers Acceptances, which was used by two South Florida Banks.
In addition to representing many banking institutions, Mr. Phelan has also represented the governmental agencies of the F.D.I.C., O.T.S. and R.T.C. in regulatory and statutory matters, complex commercial and real estate foreclosures, forfeitures, lender liability actions, transactional and loan workouts, and was responsible for achieving one of the highest verdicts on behalf of the R.T.C. in the amount of $10 million.
REAL ESTATE
Mr. Phelan has negotiated, documented and closed multi-million dollar real estate loans, has litigated multi-million dollar foreclosure lawsuits, and is an approved agent for Commonwealth Title. He has represented developers, banks and individuals in transactional matters and has litigated real estate related disputes
